Welcome to Dada’s Dabba Private Limited (“Dada’s Dabba”, “we”, “our”, “us”). By accessing our website, placing an order, or using any of our services, you agree to be bound by the following Terms & Conditions (“Terms”). Please read them carefully.

1. Acceptance of Terms:

By using our website or services, you confirm that:
 You are at least 18 years of age, and
 You have read, understood, and agreed to these Terms

If you do not agree, please do not use our services.

2. Nature of Services:

Dada’s Dabba is a cloud kitchen offering freshly prepared food for takeaway and delivery through:
 Our website
 Phone / WhatsApp/ Telegram orders
 Third-party

Availability of items may vary based on location, time, and operational capacity.

3. Order Placement & Order Acceptance:

 Orders are to be placed by 11:00 pm on Previous day for lunch & 10:00 am on same day for dinner.
 All orders placed are subject to acceptance by Dada’s Dabba.
 We reserve the right to refuse or cancel any order due to:

o Unavailability of items
o Incorrect pricing or menu information
o Operational constraints
o Suspected fraudulent activity

Order confirmation does not guarantee delivery unless payment is successfully completed (where applicable).

4. Pricing & Payment:

 All prices are displayed in Indian Rupees (INR) and are exclusive of taxes.
 Prices may change without prior notice.
 Payments can be made via UPI, cards, wallets, net banking.
 We do not store card or payment instrument details.

In case of payment failure, the order shall be treated as incomplete.

5. Delivery & Timelines:

 Delivery times provided are estimated and may vary due to traffic, weather, demand, or third-party delivery partners.
 Delays do not entitle customers to compensation or cancellation once food preparation has started.
 Responsibility for delivery logistics through third-party platforms rests with those platforms, if any.

6. Cancellations & Refunds:

a) Order Cancellation
 Orders once accepted and started preparing cannot be cancelled.
 Cancellation requests will be considered only by 4:00 am for lunch & 1:00 pm for dinner.

b) Refund/ Replacement Policy
Refund/ Replacement may be issued only in cases such as:
 Wrong item delivered
 Quality issues reported immediately upon delivery
 Order not delivered (after acceptance)

Refund/ Replacement, if approved, will be processed to the original payment mode within 48 hours of working days.

7. Food Quality & Consumption:

 All food is prepared in hygienic conditions following FSSAI guidelines.
 Customers are advised to:
o Consume food immediately or
o Store as per recommended conditions

We are not responsible for quality issues arising due to delayed consumption, improper storage, or
reheating.

8. User Responsibilities You agree:

 To provide accurate contact and delivery details
 Not to misuse the website or services
 Not to place fake, bulk, or malicious orders
 Not to engage in abusive, threatening, or unlawful conduct toward staff or delivery personnel Violation may result in suspension or permanent blocking of services.

9. Intellectual Property
All content on the website, including:

 Brand name
 Logo
 Images
 Text
 Menu designs
are the intellectual property of Dada’s Dabba Private Limited and may not be copied, reproduced, or used without prior written permission.

10. Third-Party Platforms & Links:

Our website may contain links to third-party services or delivery platforms. We are not responsible for:
 Their terms & conditions
 Privacy practices
 Service failures

Orders placed via third-party platforms are governed by their respective terms.

11. Limitation of Liability To the maximum extent permitted under law:

 Dada’s Dabba shall not be liable for indirect, incidental, or consequential damages
 Our total liability shall not exceed the value of the order placed

12. Force Majeure:

We shall not be liable for failure or delay in performance due to events beyond our control, including but not limited to:
 Natural disasters
 Government restrictions
 Strikes
 Power or internet failures
 Unforeseen Road incidents

13. Indemnity:

You agree to indemnify and hold harmless Dada’s Dabba Private Limited from any claims, losses, damages, or expenses arising from
 Your misuse of the services
 Violation of these Terms

14. Governing Law & Jurisdiction:

These Terms shall be governed by and interpreted in accordance with the laws of India. Courts located in Kolkata, West Bengal shall have exclusive jurisdiction.

15. Amendments:

We reserve the right to modify these Terms at any time. Updated versions will be posted on the website. Continued use of our services constitutes acceptance of the revised Terms.
